Love Is Blind contestant’s appeal against show in arbitration is rejected

Love is blind Candidate Renee Poche’s attempt to appeal the decision on her lawsuit was rejected.

Poche, whose storyline was not shown in Season 5 of the Netflix series, sued the streamer and its production company Delirium TV in January. In a lawsuit obtained by PEOPLE at the time, she claimed to be the victim of “unlawful employment practices,” “unfair competition” and “intentional infliction of emotional distress.”

In March, Los Angeles Superior Court Judge Bruce G. Iwasaki denied Poche’s request to avoid arbitration in the lawsuit, a major victory for Delirium TV.

On July 3, PEOPLE obtained a new filing stating that Judge Iwasaki denied Poche’s request to appeal the arbitration decision – another victory for the production company.

In the first dismissal in March, Judge Iwasaki said Poche and her lawyers had “absolutely no evidence” that participating in arbitration – required under her agreement with Delirium – would harm her, according to a press release.

Poche was also allegedly “ordered to cease her unauthorized interviews and immediately resolve the dispute. She was also repeatedly warned by production staff and Delirium’s attorneys that her continued violations of the Participant Agreement would result in Delirium initiating arbitration,” the press release states.

In a statement, the production company’s lawyers said they were “very satisfied” with the outcome of the hearing, which they said was due to Poche’s “violation of her confidentiality and publicity obligations.”

“The arbitration procedure is the procedure set out in the agreement that Ms. Poche signed when she agreed to participate in Love is blind“, the statement said. “But rather than defending herself against Delirium’s claims in arbitration, Ms. Poche and her lawyers have decided to file a headline-grabbing lawsuit against Delirium and Netflix in court, with a morass of arguments challenging the enforceability of the agreement she signed.”

In her initial complaint, Poche claimed that Netflix and Delirium TV set her up with her ex-fiancé, Carter Wall. And although she claimed that “all participants were vetted and marriageable,” she was “totally terrified to be around him.”

The veterinarian from Austin, Texas, further claimed that Wall was “emotionally abusive on and off camera, lied viciously, and abused drugs and alcohol on a massive scale.” She claimed she was told she would “take legal action if she discontinues her participation in the (show) or otherwise refuses to continue the engagement.”

In a statement to PEOPLE, Poche cited her experience on Love is blind “traumatic.”

“I felt like a prisoner and had no support when I let Delirium know I didn’t feel safe. I tried to deal with these feelings over time and eventually felt like I needed to share what had happened. I felt it was only right to let others know the truth about what all the participants had endured.”
