Hunter Biden sues Fox News over mock trial series

Hunter Biden sued Fox News over his streaming service’s mock trial series that featured sexually explicit images of the president’s son.

The trial of Hunter Biden was a fictional trial based on Biden’s legal troubles that until recently ran on the subscription service Fox Nation.

But after legal threats from Hunter Biden’s lawyers, Fox canceled the series in April.

In their lawsuit before the New York State Supreme Court, Biden’s lawyers argue that the series remains available on third-party streaming platforms and that promotional videos and clips remain.

Biden’s lawyers are not suing Fox News for defamation, but for violating the state’s civil rights law, which prohibits the nonconsensual publication of sexually explicit images and videos, or “revenge porn.” The suit also alleges intentional infliction of emotional distress and unjust enrichment.

“Fox’s unlawful publication and distribution of the intimate images was not for a legitimate public purpose because the miniseries depicting a mock trial does not truthfully report newsworthy events but rather depicts a fictionalized trial in a nonexistent case against Mr. Biden that was produced for entertainment purposes,” the lawsuit states.

A Fox News spokesperson said in a statement: “This purely politically motivated lawsuit is without merit. The core complaint relates to a 2022 streaming program that Mr. Biden first complained about in a letter in late April 2024. The program was removed out of an abundance of caution within days of the letter, but Hunter Biden is a public figure who has been the subject of multiple investigations and is now a convicted felon. In accordance with the First Amendment, Fox News has accurately covered newsworthy events of Mr. Biden’s own making, and we look forward to asserting our rights in court.”

The lawsuit seeks “an order directing the defendants to remove and delete any publication of an intimate image of Mr. Biden and to remove any intimate image of Mr. Biden from their
possession, custody or control” and profits from The trial of Hunter Bidenamong other things.
