Class action lawsuit against Popeyes: Employees must work through lunch breaks

A new class action lawsuit against Popeyes alleges that the restaurant chain forced its employees to work without pay during their lunch and rest breaks and provided “confusing” pay stubs in violation of California labor law.

Plaintiff Jose Mendoza Gonzalez filed the class action lawsuit against Popeyes on behalf of himself and other Popeyes employees in California who allegedly worked without receiving the wages they were entitled to under Labor Laws in California.

Not only did Popeyes fail to pay some of its California employees for all of their labor, the restaurant also allegedly provided false pay stubs to its employees so they could not discover the violations of California labor law.

Class action lawsuit against Popeyes alleges multiple violations of California labor law

Popeyes also allegedly failed to provide the alleged gang members with legally required uninterrupted meal and rest breaks, Gonzalez says. He says Popeyes frequently required its employees to work during their meal and rest breaks without adequately compensating them.

Gonzales alleges that Popeyes regularly requires its employees to work shifts of more than five hours without an uninterrupted lunch break and shifts of more than ten hours without a second meal break of at least 30 minutes.

In addition, Popeyes failed to pay “extra pay” equal to the hourly wage for each missed meal break, which is a violation of California law, Gonzalez claims.

Because of missed meal and rest breaks, employees often worked shifts of more than eight hours per day and 40 hours per week, but were not paid overtime, according to the Popeyes class action lawsuit.

In addition, Popeyes allegedly provided its employees with pay stubs that did not accurately reflect wages, overtime, and bonuses for missed meal and rest breaks, even though the restaurant chain knew that the employees were entitled to such pay.

Popeyes also failed to reimburse its employees for expenses related to purchasing products they needed to do their jobs, such as dishwashing detergent, Gonzales alleges.

The Popeyes class action lawsuit alleges various violations of California labor law, including failure to pay minimum wage and overtime pay, failure to provide uninterrupted meal breaks or adequate compensation for missed breaks, and other violations.

Popeyes previously faced a Class action lawsuit for misleading advertising She claims that the company deceived consumers by making them believe that its menu item “Chicken Tender” consisted exclusively of chicken fillet meat.
