Temu text messages are “annoying” and illegal, says class action lawsuit

Temu Text Messaging Class Action Lawsuit Overview:

E-commerce company Temu sends telemarketing text messages to consumers whose phone numbers are listed on the national Robinson list, according to a new class action lawsuit.

Plaintiff Phyllis King’s class action lawsuit alleges that Temu sent telemarketing text messages without consumers’ prior express written consent and in violation of Law to protect telephone customers (TCPA).

“The TCPA and its implementing regulations prohibit the initiation of telephone advertisements for residential telephone lines in the National Robinson Registry and provide a private right of action against any business that makes such calls,” Temu’s class action lawsuit states.

King seeks to represent a group of consumers who received more than one telemarketing phone call/text message from Temu within a 12-month period over the past four years to a residential telephone that was on the national Robinson list for at least 31 days without first giving their express consent.

Temu violated consumer privacy through “annoying,” “harassing” telemarketing calls and class action lawsuits

King argues that Temu also violated consumers’ privacy through “annoying” and “harassing” calls, which she believes “constitutes harassment.”

“The calls also tied up Plaintiff’s and class members’ phone lines, took up their time, and prevented them from receiving legitimate messages,” Temu’s class action lawsuit states.

The plaintiff is demanding a jury trial and is seeking declaratory and injunctive relief as well as an award of statutory damages for herself and all members of the class action suit.

A consumer filed a separate class action lawsuit against Temu last September, claiming the company’s customers were at “ongoing risk” of having their personal information disclosed because the company allegedly relaxed security policy.
