Class action lawsuit against Surfshark: Company uses automatic renewal system

Surfshark Auto-Renewal Class Action Lawsuit Overview:

A recently amended class action lawsuit alleges that Surfshark fraudulently enrolled “unwary” consumers in an auto-renewing payment plan for the cybersecurity company’s products and services.

Plaintiff Emily Pachoud’s amended class action lawsuit alleges that Surfshark lures consumers and forces them into an automatic renewal plan without disclosing “material facts” about how they are paying, as required by California law.

“Plaintiff and other consumers were deceived by Defendant’s actions and consequently tricked into entering into an automatic recurring payment plan,” Surfshark’s class action lawsuit states.

Pachoud seeks to represent a group of California consumers who were automatically enrolled in Surfshark products and who were charged at least one renewal fee by the company within the applicable statute of limitations.

Surfshark does not obtain explicit consent from consumers before automatic renewal, class action lawsuit says

Pachoud argues that Surfshark fails to obtain consumers’ explicit consent before charging them and that the terms of the offer’s renewal are not clearly laid out on its website.

“A consumer can easily use the website and complete their purchase without viewing these terms. This means that the defendant does not meet the (legal) proximity requirement,” Surfshark’s class action lawsuit states.

Pachoud claims that Surfshark is guilty of quasi-contract and unjust enrichment and violates the California Law on misleading advertising, Unfair competition And Law on Consumer Protection Means.

She is demanding a jury trial and is seeking declaratory judgment and injunctive relief and an award of all economic and financial damages, actual damages, consequential damages, compensatory damages, treble damages and punitive damages for herself and all members of the class.

Two consumers filed a similar class action lawsuit against Paramount Global late last year because the entertainment company claimed Continue loading Consumers who have already canceled their subscriptions to the Paramount+ streaming service.
