Apple App Store consumer class action lawsuit set for jury trial in February 2026

Apple will now face a $7 billion class action lawsuit in federal court in California in February 2026. The company is accused of monopolizing the app market for its iPhones, forcing tens of millions of customers to pay higher prices.

U.S. District Judge Yvonne Gonzalez Rogers set the date for the jury trial in an order (opens new tab) on Thursday after deciding earlier this year to allow the case to proceed as a class action lawsuit that includes all U.S. Apple customers who have spent $10 or more on Apple apps or in-app purchases since 2008.

The lawsuit, filed in 2011, accuses Apple of artificially inflating the 30 percent commission on sales charged to developers in the company’s App Store, passing the excessive fees on to consumers in the form of higher app prices.

An expert for the plaintiffs estimated the damages at between $7 billion and $10 billion, according to court documents. An appeals court in May rejected Apple’s request to hear its challenge to the class action lawsuit before trial.

Apple did not immediately respond to a request for comment. Apple denies any wrongdoing.

A lawyer for the plaintiffs, Mark Rifkin of Wolf Haldenstein Adler Freeman & Herz, said Friday that “almost all of the preparatory work is complete and we look forward to trial in this important case.”

In another case, Rogers is examining whether Apple complied with an order to give developers more freedom to offer consumers alternative payment options for in-app purchases.

This lawsuit by “Fortnite” maker Epic Games was not about financial damages.

The US government and a group of states are suing Apple in federal court in New Jersey for allegedly monopolizing the smartphone market. Apple has denied the allegations and announced that it will ask a judge to dismiss the lawsuit. The first major hearing in the case is scheduled for July 17.
