Fish Oil Supplement Class Action Lawsuit Overview:

  • WHO: Dayna Clark has filed a class action lawsuit against Nordic Naturals Inc.
  • Why: Clark claims that Nordic Naturals falsely claims that the fish oil supplements it sells are beneficial for heart health.
  • Where: The class action lawsuit was filed in federal court in California.

A new class action lawsuit alleges that Nordic Naturals falsely claims that its fish oil supplements support heart health.

In her class action lawsuit, plaintiff Dayna Clark claims that studies on fish oil supplements such as those sold by Nordic Naturals have shown that they can be harmful to heart health and are a waste of money for consumers.

“Ms. Clark read and relied on the statement that the product promotes heart health. She would not have purchased the product if she had known that the product did not promote heart health – and may even harm it,” Nordic Naturals’ class action lawsuit states.

Clark seeks to represent a statewide group, a California subgroup and a multi-state consumer protection subgroup that includes anyone who has purchased one or more Nordic Naturals fish oil capsules.

Studies show fish oil supplements are no better than placebos, class action lawsuit says

Studies have shown that there is no evidence that fish oil supplements improve a person’s cardiovascular health, argues Clark. They are nothing more than a placebo and are even harmful to heart health.

“By selling products that supposedly support heart health, Nordic Naturals suggests to customers that taking its fish oil capsules is beneficial for heart health,” Nordic Naturals’ class action lawsuit states.

Clark alleges that Nordic Naturals is guilty of willful misrepresentation and omission, negligent misrepresentation and omission, breach of express warranties and quasi-contracts, and violation of consumer protection laws of several states.

Plaintiff is demanding a jury trial and is seeking an injunction and an award of treble and punitive damages for herself and all class members.

A consumer filed a similar class action lawsuit earlier this year against Nestlé Health Sciences US LLC and its Nature’s Bounty brand, alleging that the company makes false advertising Nature’s Bounty fish oil supplements have positive effects on cardiovascular health.
