The Milwaukee County District Attorney’s Office is investigating the manslaughter death of D’Vontaye Mitchell, who died June 30 after security guards held him facedown outside the Hyatt Regency hotel.

Milwaukee-based civil rights attorney William Sulton met with members of the district attorney’s office Wednesday morning, according to a statement from the prosecutor’s office. Sulton was updated on the “ongoing police investigation” and was able to review video footage and other evidence related to the investigation.

“Our office is investigating Mr. Mitchell’s death as a homicide,” the statement said. “We are currently working with police investigators to await the full results of an autopsy conducted by the Milwaukee County Medical Examiner.”

The Milwaukee County Coroner’s preliminary autopsy determined Mitchell’s death was homicide.

The final results of the autopsy will serve as the basis for the ongoing police investigation and will allow prosecutors to “fully evaluate the actions that led to Mr. Mitchell’s death from the perspective of possible criminal liability,” the statement said.

“All aspects of these actions, including the death of Mr Mitchell and the use of violence by hotel staff, are being closely investigated,” the statement said.

The news comes two days after civil rights attorneys Ben Crump, Sulton and B’Ivory Lamarr called for charges to be brought against the security guards, and hours before a protest rally was scheduled for Wednesday afternoon outside the district attorney’s office.

Mitchell, 43, died around 4 p.m. on June 30 after allegedly entering the ladies’ room at the Milwaukee hotel (333 W. Kilbourn Ave.). Crump said Mitchell was going through a mental health crisis, but Milwaukee police have not released any information about that.

According to the Hyatt, the security guards involved in Mitchell’s arrest have been suspended.
