Class action lawsuit against Redfin: Company tracks website users and shares data

Real estate company Redfin tracks the video activity of its website users and shares that and other sensitive data with its third-party code providers — all without their consent, a new class action lawsuit alleges.

In his class action lawsuit, plaintiff Guillermo Mata alleges that Redfin did not obtain valid consent from its users before using third-party code to track and share the personally identifiable information (PII) and recorded videos they watch.

“These tracking technologies collect the personal information of Defendant’s subscribers relating to specific videos the subscribers have viewed and share that personal information with third-party developers – all without the subscribers’ informed, written consent,” Redfin’s class action lawsuit states.

Mata seeks to represent a nationwide class and a California subclass of consumers who have a Redfin account and who requested or viewed a guided video tour on or through Redfin during the applicable statute of limitations.

Redfin violated the Video Privacy Protection Act, class action lawsuit claims

Mata claims that Redfin violated the Video Data Protection Act (VPPA) and the California Invasion of Privacy Law.

“In direct violation of the protections afforded by the VPPA, Defendant shares its consumers’ personal information with third-party companies without first obtaining their written consent,” Redfin’s class action lawsuit states.

The plaintiff demands a jury trial and seeks declaratory and injunctive relief as well as an award of statutory and punitive damages for himself and all class members.

A consumer filed a similar class action lawsuit earlier this year against Kia America, Kia Corp. and LexisNexis Risk Solutions for allegedly collecting driver data. without full consent and passed that data on to LexisNexis, which in turn allegedly sold the data to insurance companies, resulting in an increase in drivers’ insurance premiums.
