CallCore Media settles TCPA class action lawsuit for $2 million

CallCore Media settles TCPA class action lawsuit for million

TWO MILLION DOLLARS WAY: Court finally approves CallCore TCPA class action settlement of $2 million

A few years ago, E-trade did a Super Bowl commercial that featured a monkey and a bunch of random people in a garage clapping along to La Cucaracha. At the end of the commercial, a graphic reads:

“Well, we just wasted two million dollars.”

If you are interested, take a look here:

I suspect the folks at CallCore Media feel the same way.

On Tuesday, a Texas court finally approved a settlement under which CallCore (and its insurer) will pay $2 million to a class of people who allegedly received illegal marketing calls in violation of the TCPA.

Each class member who makes a claim is expected to receive $450.00, which is quite a good amount of compensation in a TCPA class action lawsuit.

The lawyers, of course, come out better – they are left with $666,666.67 (the devil’s number!) in fees and costs.

The settlement classes are:

TCPA Class: The persons to whom calls were made by or on behalf of CallCore and whose information was received by
PHBC and the calls were forwarded to CallCore.
Texas Class: Those persons with Texas addresses and/or Texas area codes to whom calls were made by or on behalf of CallCore,
whose information was obtained from PHBC and the calls were forwarded to CallCore.

Yes, PHBC – whatever that is – was apparently a lead source that got CallCore in trouble. Another cautionary tale about buying leads, I guess.

The case is Burnett v. Callcore Media, Inc. 2024 WL 3166453 Civil Action No.: 4:21-cv-03176 (SD Tex. 6/25/2024).
