1,000 Settlement in Baptist Memorial Health Care FCRA Class Action Lawsuit

Applicants who applied for a position at Baptist Memorial Health Care and who had a background check completed were able to benefit from a severance payment of $420,566.

Two groups benefit from the agreement: the disclosure group and the pre-trial measures subgroup.

The disclosure class includes individuals who applied for a job at Baptist Memorial Health Care and for whom a background report was obtained between June 7, 2019, and August 8, 2022.

The subset of Class Members facing adverse action includes those who were not employed by Baptist Memorial Health Care, who are marked as “Background Report Failed,” “Nil,” or “Other” in the company’s system, and for whom Baptist Memorial could not confirm that they received notice of adverse action.

Plaintiffs in the class action lawsuit allege that Baptist Memorial Health Care failed to comply with the Fair Credit Reporting Act in obtaining consumer reports on job applicants and taking action against them. The health care system allegedly failed to provide disclosures required by the FCRA.

Baptist Memorial is a hospital and health system with locations in Tennessee, Missouri and Arkansas.

Baptist Memorial Health Care has not admitted wrongdoing but has agreed to pay $420,566 to settle the FCRA class action lawsuit.

Under the terms of the settlement, class members may receive cash payments based on their class action. Disclosure class members may receive up to $26, while pre-trial class members may receive up to $500.

The deadline for exclusion and appeal is July 12, 2024.

The final hearing to approve the settlement is scheduled for September 19, 2024.

To receive settlement payments, class members must submit a valid claim form by July 29, 2024.
