TO man accused of death of roommate released from prison

A Thousand Oaks man arrested last week on suspicion of killing his 80-year-old roommate was released from jail Monday without charges.

Edward Fegley, 80, was initially accused of shooting his longtime friend and roommate Gerald Sherman. The Ventura County Sheriff’s Office, which contracts to handle police work in Thousand Oaks, is investigating the June 19 murder at the home the couple was sharing on Avenida de Las Plantas.

Sheriff’s officials said Tuesday that the Ventura County District Attorney’s Office has decided not to file charges against Fegley at this time, adding that the decision is not unusual and prosecutors may need more evidence to file charges.

Jail records show Fegley was released due to the “statute of limitations.” He was not acquitted, sheriff’s officials said.

“Our major crimes investigators continue to gather evidence to build a stronger case,” Captain Dean Worthy said in a statement. “The Ventura County Sheriff’s Office remains committed to bringing justice to the victims and we will continue to keep the public updated as the investigation progresses.”

It was not immediately clear whether Fegley has an attorney.

Investigators had previously stated that a physical altercation occurred between Fegley and Sherman in their single-family home. At some point, Sherman was shot.

Officers arrived shortly after 10 a.m. on June 19 and Sherman was pronounced dead at the scene. Fegley was subsequently arrested.

Investigators also seized a .22-caliber rifle from the home that they believe was used in the shooting. They had previously said the men were involved in some sort of fight and they are trying to understand the circumstances that led to the shooting.
