Overview of the Apple Discrimination Class Action Lawsuit:

  • WHO: Plaintiffs Justina Jong and Amina Salgado have filed a class action lawsuit against Apple Inc.
  • Why: Jong and Salgado claim that Apple discriminates against its female employees by paying them less than their male colleagues who perform “substantially similar” work.
  • Where: The class action lawsuit was filed in the Supreme Court of the State of California, County of San Francisco.

A new class action lawsuit accuses Apple of discriminating against its female employees by systematically paying them lower wages than their male colleagues.

The class action lawsuit filed by plaintiffs Justina Jong and Amina Salgado alleges that Apple pays its female employees lower wages than its male employees who perform “substantially similar” work under similar working conditions.

“Apple’s failure to pay men and women equal wages for performing substantially similar work is not justified by any legal reason,” Apple’s class action lawsuit states.

Jong and Salgado, both currently employed at Apple, are seeking to represent a group of women who have worked at Apple in engineering, AppleCare and marketing in California at some point in the past four years.

Class action lawsuit: Apple’s performance evaluation system is biased against female employees

Jong and Salgado argue that one way Apple discriminates against women is by using a biased performance evaluation system that rewards men for the same behaviors that women are penalized for in categories such as teamwork and leadership.

“Because performance appraisal scores are tied to bonuses, restricted stock units (RSUs), and salary increases at Apple, Apple’s biased performance appraisal system disequally impacts women,” Apple’s class action lawsuit states.

Jong and Salgado claim that Apple is guilty of violating the California Equal Pay ActThe California Fair Employment and Housing Act and California Unfair competition.

The plaintiffs are demanding a jury trial and are seeking declaratory and injunctive relief as well as an award of liquidated damages for themselves and all members of the class action suit.

Recently, several lawsuits have been filed against Apple by consumers, the government and state attorneys general for claims related to Monopoly actions the company is accused of.
