A new class action lawsuit accuses Ticketmaster and its parent company Live Nation of failing to adequately secure and protect the personal information of hundreds of millions of people in a recent data theft.

In their class action lawsuit, plaintiffs Shannon Spencer, Gerry Mcauley and Ryan Jossart claim that Ticketmaster’s data theft was a direct result of the company’s failure to implement “adequate and reasonable cybersecurity procedures and protocols.”

“Defendants have violated the rights of plaintiffs and class members by, among other things, intentionally, willfully, recklessly, or negligently failing to take reasonable and appropriate steps to ensure that their data systems are protected from unauthorized access,” Ticketmaster’s class action lawsuit states.

Spencer, Mcauley and Jossart seek to represent a nationwide class of individuals whose personal information was accessed and/or obtained by an unauthorized party as a result of the data breach.

Consumers face “increased” and “immediate” risk of fraud due to Ticketmaster data breach, class action lawsuit demands

Spencer, Mcauley and Jossart argue that the data breach exposed them and other affected consumers to an “increased and immediate” risk of fraud and identity theft.

“Plaintiffs and class members must closely monitor their bank accounts now and in the future to protect themselves from identity theft,” the class action lawsuit against Ticketmaster states.

Spencer, Mcauley and Jossart claim that Ticketmaster and Live Nation are guilty of negligence and carelessness per se, unjust enrichment and breach of an implied contract, and violation of California Unfair competition.

Plaintiffs demand a jury trial and seek declaratory and injunctive relief, as well as an award of actual, nominal, statutory, consequential and punitive damages for themselves and all class members.

ShinyHunters, the group allegedly behind the data theft, tries to blackmail Ticketmaster and Live Nation before offering the stolen data for sale for $500,000.
